1. Agreement
These Terms of Service (“Terms”) are an agreement between you and Founder Ventures Holdings, LLC, a Delaware limited liability company (“we”, “us”), for the use of Rankwise at https://tryrankwise.com, including the application, the API and our connectors (the “Service”). By creating an account or using the Service, you accept these Terms. If you accept them for a company, you confirm that you can bind that company, and “you” means that company.
2. The service
Rankwise helps you measure and improve how often AI answer engines cite your brand. Depending on your plan, it tracks citations, scores domains and content, drafts articles with AI, and publishes to the websites you connect. The plan description at the time of your order sets out the features and limits (for example credits, domains and checks).
We do not guarantee any result, such as a ranking, a citation or visibility in ChatGPT, Perplexity, Claude, Google or any other third-party system. Third parties run those systems and can change them at any time.
3. Your account
You must be at least 18 to use the Service. Give accurate information when you sign up and keep it up to date. Keep your login details secret. You are responsible for everything that happens under your account.
4. Plans and billing
Prices are the ones shown when you order. Prices do not include taxes, which we add where the law requires. We bill subscriptions in advance for each billing period (monthly or annual). Stripe processes payments. By ordering, you authorize us to charge your payment method for every amount due, including renewals.
Credits are used up as you use the Service, for example when you create or publish an article. Credits included in a subscription period do not roll over and are not refundable once the period ends.
If a payment fails, we may suspend access after we notify you.
5. Renewal and cancellation
Subscriptions renew automatically for the same billing period until you cancel. You can cancel at any time in Billing or by email to info@tryrankwise.com. Cancellation takes effect at the end of the period you have already paid for.
Instead of cancelling, you can pause billing in Billing for 1, 2 or 3 months. The plan runs to the end of the period already paid for. The workspace then pauses and we keep your data. On the date you chose, billing and the plan start again automatically. You can resume earlier or cancel during the pause.
6. 3-day free trial and 14-day money-back guarantee
(1) 3-day free trial. Every self-serve plan starts with a free trial of 3 days. You enter a payment card when you sign up. When the trial ends, the paid plan you chose starts and we charge its price to that card, unless you cancel in Billing before the trial ends. Before the trial starts, we show the price, the billing interval and the date of the first charge. The free trial applies once per customer. We identify a customer by workspace, account email address, payment card and tracked website. A customer who already had a free trial pays from the start, and we say so before payment.
(2) During the trial, the plan's features are available with trial limits (a smaller credit allowance and fewer citation checks). Articles written during the trial carry a Rankwise watermark and cannot be published to a connected website until the paid plan starts. You can start the paid plan early in Billing; the trial then ends and we charge the plan price at once. If you cancel during the trial, access ends at once and nothing is charged. The workspace pauses and we keep your data. Free trials we grant individually are not affected by this paragraph.
(3) 14-day money-back guarantee. You can request a full refund within 14 days of the first successful payment on your workspace. After a free trial, the first successful payment is the first charge at the end of the trial, not the start of the trial. The refund covers every payment on that workspace in those 14 days, including upgrades, except add-on credits (see (6)). We refund the full price paid to the original payment method and deduct no fees. Your bank usually shows the refund within 5 to 10 business days.
(4) You request the refund in Billing, or by email to info@tryrankwise.com. When we issue it, the subscription ends at once and the workspace pauses. We keep your data, and you can reactivate the workspace with a paid plan.
(5) The guarantee applies once per customer. We identify a customer by workspace, account email address and payment card. A customer who already used the guarantee can buy a plan again, but without a new guarantee. We say so before payment.
(6) Add-on credits bought in those 14 days are not refundable. The refund covers the plan payments.
(7) If the workspace uses more than 3 times its plan's monthly credits in those 14 days, our team reviews the request before we issue the refund. We do not refuse a request without a reply.
(8) After the 14 days, payments are not refundable. Plans renew automatically until you cancel, and you can cancel at any time to stop future renewals (section 5).
7. Acceptable use
You agree not to use the Service to:
- break the law or infringe anyone's rights (for example copyright, trademark or privacy);
- create or send spam, or deceptive or misleading content;
- break the terms of a third-party service you connect to Rankwise;
- scrape the Service outside our API, or harm its security or availability;
- resell the Service without our written permission.
You must review AI-generated drafts for accuracy, legality and any required disclosures before you publish them.
8. Your content
You keep all rights to the content and data you put into Rankwise. You give us a license to store, process and, when you tell us to, publish that content to the systems you connect, only as far as we need to provide the Service during your subscription. You confirm that you have the rights to the content you submit and to the domains and systems you connect.
Once you have paid, you may use, edit and publish the content the Service generates for you for any purpose. AI-generated content may not be protected by copyright, and other users may receive similar output.
9. AI output and third parties
Parts of the Service rely on third parties, such as AI model providers and data suppliers. We do not control their availability, behavior or results. AI output can be incomplete, outdated or wrong. It is not legal, tax or other professional advice. Visibility metrics (for example citation frequency) come from samples of third-party systems and naturally change over time.
10. Availability
We work to keep the Service available, but we do not promise it will be uninterrupted, unless we agree to a service level in writing. Maintenance, problems at third-party providers or on the internet, and events outside our control can cause downtime. We announce planned maintenance in advance where we can.
11. Disclaimer
EXCEPT AS THESE TERMS EXPRESSLY STATE, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
12. Limitation of liability
TO THE EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM.
Keep your own backups. We are not liable for lost data that a reasonable backup would have let you restore.
13. Indemnity
You will defend and indemnify us against third-party claims that arise from your content, your use of the Service in breach of these Terms, or your breach of the law.
14. Termination
You can stop using the Service and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these Terms, or if the law requires it. Where we can, we tell you first. Sections 8 (license to generated content), 11, 12, 13 and 17 survive termination.
15. Privacy
Our Privacy Policy explains how we handle personal information. If you need a data processing agreement for personal data we process for you, email info@tryrankwise.com.
16. Changes to these Terms
We may change these Terms. If a change is material, we tell you by email at least 30 days before it takes effect. If you keep using the Service after that date, you accept the new Terms. If you do not accept them, you can cancel before they take effect.
17. Governing law and general terms
The laws of the State of Delaware govern these Terms, without regard to its conflict-of-law rules. The state and federal courts in Delaware have exclusive jurisdiction over any dispute about these Terms or the Service, and both parties consent to it. If a court finds part of these Terms unenforceable, the rest stays in effect. These Terms are the entire agreement between you and us about the Service. You may not transfer them without our consent. We may transfer them as part of a merger, sale or reorganization.
